It was made based on a statement from a convicted criminal who claimed he &#8216;brandished&#8217; the gun at her when he merely took it out to put the safety on before returning to his house.<\/p>\n<p>Even so, &#8216;brandishing&#8217; should not be a crime on one&#8217;s own property if one is feeling threatened or if a trespasser refuses to leave when asked.
